HOUSE CONCURRENT RESOLUTION 95

Requesting the Joint Committee on Government and Finance conduct a
study on the regulation of all-terrain vehicles and the impact
recent legislation has had on the safety of riders and
operators of all-terrain vehicles.
Whereas, Safety regulations of all-terrain vehicles in West
Virginia have become an increasing concern for the Legislature and
the citizens of West Virginia; and
Whereas, The Legislature has enacted certain safety regulations
relating to the operation of all-terrain vehicles in West Virginia,
and has attempted to address additional concerns during the 2006
Regular Legislative Session, without a consensus; and
Whereas, Safety regulations relating to all-terrain vehicles
should be properly examined in light of 40 all-terrain vehicle
deaths in 2005 and the countless injuries from the operation of
all-terrain vehicles; and
Whereas, West Virginia has had the third highest number of ATV
related deaths and the highest death rate among all states from
1990-98, with adolescents being identified as a particularly high-
risk ATV user group; and
Whereas, The Legislature encourages additional all-terrain
vehicle safety workshops and classes to local schools and to all
groups that could benefit from all-terrain vehicle safety
regulation and recognize that there is a need for additional,
reasonable and sensible safety regulations relating to all-terrain
vehicles; therefore, be it
Resolved by the Legislature of West Virginia:
That the Joint Committee on Government and Finance is hereby
requested to study the regulation of all-terrain vehicles and the
impact recent legislation has had on the safety of riders and
operators of all-terrain vehicles; and, be it
Further Resolved, That the Joint Committee on Government and
Finance report to the regular legislative session of the
Legislature, 2007, on its findings, conclusions and
recommendations, together with drafts of any legislation necessary
to effectuate its recommendations; and, be it
Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the Joint Committee on
Government and Finance.
